1. JudgeService Research Ltd (JudgeService) provides the "Referral Manager" referral and reward system to allow customers (referrers) to make referrals of people that they know, who may be interested in purchasing products or services from Vertu Motors plc or any of its subsidiary companies trading under the names of: Vertu Motors, Bristol Street Motors, and / or Macklin Motors (the Vertu Group).

  2. You agree to these terms and conditions by making a referral (Terms and Conditions) and any information or guidance published by JudgeService or the Vertu Group form part of these Terms and Conditions.

  3. Any referrals made using the system must be a new customer or prospect to the Vertu Group. There is no limit on the number of referrals you may make for friends or family as long as they meet the requirements for being new introductions to the Vertu Group.

  4. Referring yourself or employees of the Vertu Group or its affiliates is not permitted using this system nor are referrals of members of employees' families (defined as parents, children, siblings, spouse, and life partners).

  5. All rewards and offers are provided by the Vertu Group or their agents and they reserve the right to amend, modify, cancel, or withdraw all rewards and offers at any time and for any reason, without notice.

  6. JudgeService is not responsible for any rewards, offers, or referrals made on the "Referral Manager" system.

  7. By entering your personal data in the "Referral Manager" system you are giving permission for your data to be shared with the Vertu Group, their affiliated companies and, for the purpose of supplying the rewards and offers, any authorised agent, and voucher partner and by entering the details of people you wish to refer, you confirm that they have consented to their data being provided and shared with the Vertu Group, their affiliated companies, agents, and voucher partners for this purpose. All personal data will be processed in accordance with the Vertu Group Privacy Policy.

  8. Personal data related to the referee will be stored and shared with the Vertu Group, their affiliated companies, agents, and voucher partners for the purposes of use within the refer and reward system only.

  9. All referrals must be made prior to initial enquiry, order, and / or purchase of a vehicle from the Vertu Group. If the order for a vehicle is cancelled, you will not be eligible to receive the reward. If the vehicle is returned within 14 calendar days of delivery, you will not be eligible to receive the reward.

  10. In case of multiple people referring a customer, the date and time of entry within the "Referral Manager" system will be the arbiter of the first referee of a 'new' customer and the second referral will not be accepted as the customer will no longer be 'new'.

  11. All claims for rewards, queries, or grievances about referrals must be made with the Vertu Group direct. In the unlikely event of a dispute, Vertu Group' decision shall be final. Participants in this reward and offer agree that the Vertu Group will have no liability whatsoever for any injures, costs, damage, disappointment, or losses of any kind resulting in whole or in part, directly or indirectly from participation in this reward and offer. Nothing in this clause shall limit Vertu Group' liability in respect of death or personal injury arising out of its own negligence or liability arising out of its fraud.

  12. JudgeService reserves the right to change, suspend, and / or cancel the "Referral Manager" service at any time for any reason without notice.

  13. All terms are subject to change and should be read in conjunction with any Vertu Group terms and any voucher partner terms attached to issued vouchers that may be prevalent at the time of referral or claiming of rewards.

  14. You will receive your referral reward for each vehicle delivered to a friend or family member within 28 days of delivery of the vehicle by a member of the Vertu Group.

  15. Vouchers are fulfilled by our voucher partners and are subject to change at any time without notice.

  16. If you attempt to compromise the integrity or the legitimate operation of this reward and offer by cheating or commiting fraud in ANY way, JudgeService and / or the Vertu Group may seek damages from you to the fullest extent permitted by law. Further, your claim will be refused and cancelled in our absolute discretion, and we may ban you from participating in any future promotions run by JudgeService, the Vertu Group, or any of its affiliates. JudgeService and the Vertu Group shall have the right, where necessary, to undertake all such action as is reasonable to protect themselves against fraudulent or invalid claims including, without limitation, to generate or require further verification as to proof of purchase, as well as your identity, age, and other relevant details, deny issuing a referral reward or terminate offer and reward due to excessive fraud. This process may involve the Vertu Group sharing information with third parties.

  17. Errors and omissions excepted.

  18. These Terms and Conditions and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of England and Wales. You irrevocably agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or its subject matter or formation (including non-contractual disputes or claims).
